尊敬的用户朋友，欢迎您与比亚迪汽车工业有限公司（下文简称“比亚迪”或“我们”）共同签署比亚迪汽车DiLink系统《数字钥匙用户服务协议》（以下简称“本协议”）并使用“数字钥匙”服务。本协议中“数字钥匙”包括NFC及UWB数字钥匙功能，简称“本应用”。
在使用本功能前，您应当仔细阅读本协议，确保您充分理解本协议各条款内容。请您审慎阅读并选择接受本协议所有条款，否则您将不能正常使用本功能，如您不同意本协议条款的任何内容，请勿开通或使用本功能。如您勾选“同意并点击立即开通”，即视为您已阅读并同意本协议，自愿接受本协议的所有内容的约束。
1.服务内容
1.1 “数字钥匙”是比亚迪汽车DiLink系统为用户提供的一种可以将手机或可穿戴设备注册为车钥匙，并用来解闭锁车门及启动车辆的服务。您可以使用手机或可穿戴设备通过添加流程将设备注册为车钥匙。具体支持的钥匙形态及功能随比亚迪汽车车型实际配置及手机或可穿戴设备支持能力共同决定。
1）当您的车辆支持UWB功能配置、且您使用的手机支持UWB功能并与比亚迪汽车UWB功能进行适配时，您可以开通NFC&UWB数字钥匙。
2）当您的车辆仅支持NFC功能、且您使用的手机或可穿戴设备支持NFC功能并与比亚迪汽车NFC功能进行适配时，您可以开通NFC（数字）钥匙，本应用在Android及鸿蒙手机端名称为“NFC钥匙”，在iOS系统手机端名称为“NFC数字钥匙”。
1.2 本应用为您提供数字钥匙管理服务（包括钥匙开通、钥匙移除、钥匙更换、钥匙更新、钥匙分享、车辆解闭锁车门或启动发动机功能），具体功能随您开通的数字钥匙类型决定，如有变更，请您及时留意我们的官方通知。
1.3 数字钥匙开通方式随比亚迪车型实际配置及手机或可穿戴设备支持能力共同决定。
1）若您的车辆支持UWB功能配置，且您使用的手机支持UWB功能并与比亚迪汽车UWB功能进行适配：您可前往“爱车—车辆设置—门窗和锁”，点击“NFC&UWB数字钥匙”按键，进入【NFC&UWB数字钥匙】页面，点击右上角“？”图标以查看本应用的操作方法、支持本应用的手机品牌和型号。
2）若您的车辆仅支持NFC功能，且您使用的手机或可穿戴设备支持NFC功能并与比亚迪汽车NFC功能进行适配：您可前往“爱车—车辆设置—门窗和锁”，“NFC数字钥匙”按键，进入【NFC数字钥匙】页面，点击右上角“？”图标以查看本应用的操作方法、支持本应用的手机及可穿戴设备品牌和型号。
2.主体资格
使用本应用服务前，您应满足以下条件：（1）您应年满十八周岁、具有法定完全民事行为能力；（2）您应为搭载有比亚迪DiLink系统及数字钥匙功能车辆的车主本人或经该车辆车主授权的用户（“授权用户”）。若您不具备前述资格，则您及您的监护人（如涉及）应承担因此而导致的一切后果，且比亚迪有权删除您的数字钥匙，并向您及您的监护人（如涉及）索偿。
3.相关资费
3.1 开通和删除数字钥匙功能需车辆支持比亚迪汽车云服务功能，比亚迪汽车云服务相关资费信息请您详细阅读《比亚迪汽车DiLink系统用户协议》。
3.2 比亚迪保留因市场变动情况、运营成本提高、应用升级及其他客观原因而在后续服务期间向您收取费用或调整收费标准的权利，请您届时留意比亚迪发布的本应用收费公告或者收费标准调整公告。
3.3 数字钥匙功能所需的网络资源需要您结合自身需求自行单独购买或开通；若您购买或开通的第三方资源或服务出现故障或问题，应由您自行联系相应第三方协商解决。
4.服务变更、中断或终止
4.1 若您的比亚迪汽车DiLink系统应用变更、中断或终止服务的，可能导致数字钥匙服务变更、中断或终止，届时您应结合比亚迪汽车DiLink系统的服务恢复、更正、更新进展留意数字钥匙服务的恢复、更正、更新进展。
4.2 如因您自行注销、关闭DiLink系统数字钥匙，或者关闭蓝牙、定位服务、NFC、UWB功能，或其他您或您的比亚迪汽车DiLink系统实际使用人的自发行为导致您的数字钥匙服务变更、中断或终止的，您应自行承担相应后果。如您需重新开通此服务的，请您依据本应用界面提示进行相应操作。
5.使用规则及相关免责
5.1 您开通、使用本应用时，应依照本应用的“使用帮助”(点击右上角“？”图标以查看)的要求和指引使用数字钥匙服务。比亚迪会对本应用进行定期或不定期应用升级、维护，请您及时留意本应用的升级、维护情况，并依据相应更新后的“使用帮助”指引使用本应用。若您或您的比亚迪汽车DiLink系统账号实际使用人在比亚迪汽车DiLink系统进行数字钥匙的增删操作，您的对应数字钥匙功能将随之变化，成功开通数字钥匙后根据对应数字钥匙权限可对车辆进行解闭锁或启动操作，成功移除数字钥匙后对应数字钥匙消失并无法对车辆进行解闭锁或启动操作。因您或您的比亚迪汽车DiLink系统实际使用人未按照“使用帮助”使用本应用而造成的任何损失，您将自行承担责任。
5.2 数字钥匙属于驾车辅助性功能，建议您随身携带您的实体钥匙。
5.3 您的搭载比亚迪数字钥匙的车辆在行驶中，本应用及其相关功能无法使用。在您的搭载比亚迪数字钥匙的车辆无需使用时，请您务必闭锁车门，如因非本应用原因致车门未闭锁及/或由此导致的人身、财产等损害的，比亚迪及搭载本应用的相关方不承担责任。若您或您的搭载本应用的车辆实际使用人使用其他方式打开车门导致车门未闭锁，由此导致的人身、财产损害等将由您自行承担。
5.4 您开通本应用后，如需出售、出借车辆或者有其他类似的车辆处置行为的，请您务必及时移除已开通的本应用或者重新开通本功能，否则因此造成的责任和后果（包括但不限于给实际购买或者使用相应车辆的第三人造成的财产损失等）将由您自行承担，与比亚迪无关。
5.5 如因非比亚迪原因（包括但不限于您的车辆设备硬件及/或软件故障等客观异常情况）导致您的数字钥匙存在其他无法正常使用情形或存在其他故障的，比亚迪不承担责任，但如有必要，比亚迪将协助您排查问题。
5.6 您理解并同意，基于现有技术限制，比亚迪可能无法就此担保本应用及相关技术免受任何攻击、不存在任何漏洞或者缺陷，但是，比亚迪将尽力确保该应用和相关技术与信息安全、有效、准确及可靠，并在法律法规规定的范围内承担相应的责任和义务。
5.7 不可抗力或我们不能控制的原因可能导致我们无法在某一特定时间或地点向您提供本应用服务，或者可能影响本应用服务的质量。例如（包括但不限于）战争、恐怖主义、自然灾害、政府行为、网络故障、系统/应用失灵、升级和维护、天气、行车事故导致您的车辆移动终端装置故障或者本应用相关设备模块损坏，比亚迪不承担任何责任。
5.8 除上述第5.1至5.7条约定之外，您与比亚迪已签署的《比亚迪汽车DiLink系统用户协议》中的“使用规则及责任限制”条款及相关条款的约定在本协议中也适用，您也应知悉并遵守相应约定。
6.信息收集及隐私保护
比亚迪高度重视对您个人信息及隐私的保护，本应用功能涉及的数据详情请参阅《比亚迪汽车DiLink系统隐私政策》。
7.其他事项
7.1 本协议所有条款标题仅为方便参考而设，在解释本协议时应予以忽略。
7.2 本协议自您勾选“同意比亚迪汽车DiLink系统《数字钥匙用户服务协议》”并点击“立即开通”后生效。如您不同意、不理解本协议中的任何内容，请勿勾选并点击前述按钮。您确认，在接受本协议之前，您已仔细阅读并充分理解了本协议的每一条款。您完全知晓并同意本协议项下全部责任免除条款以及您的权利和义务。
7.3 无论本协议中的任何条款因何种原因完全或部分无效或不具有执行力，本协议的其余条款仍应有效并且对本协议双方具有约束力。
7.4 您承诺将把此协议内容以及相关网站公示信息告知您的乘客、驾驶员或任何使用您车辆或本应用账号的人并促使同意其享有并履行与您相同的权利与义务。
7.5 本应用及服务由比亚迪提供，本应用及服务的所有权及经营权归比亚迪所有。如您对本协议有任何疑问，可通过我们的客户服务热线（400-830-3666）与我们联系，我们将据实为您进一步解释和说明相关内容。
7.6 本协议未尽事宜，则直接适用您已经同意并遵守的《比亚迪汽车DiLink系统用户协议》和《比亚迪汽车DiLink系统隐私政策》。
Digital Key User Service Agreement of BYD DiLink System
Dear user, welcome to sign the Digital Key User Service Agreement of BYD DiLink System (hereinafter referred to as this Agreement) with BYD Automobile Industry Co., Ltd. (hereinafter referred to as "BYD" or "we”) and use the “digital key” service. "Digital key" in this Agreement includes NFC and UWB digital key functions, referred to as “this app".
Before using this function, you shall read this Agreement carefully to ensure that you fully understand the terms and conditions of this Agreement. Please carefully read and choose to accept all the terms of this Agreement, otherwise you will not be able to use the function properly. If you do not agree with any content of this Agreement, please do not activate or use this function. If you check and tap the “Agree and activate now” button, you are deemed to have read and accepted this Agreement and are voluntarily bound by all the contents of this Agreement.
1. Service contents
1.1 “Digital key” is a service provided by the BYD DiLink system for car owners to register mobile phones or wearable devices as car keys and use them to unlock/lock car doors and start the vehicle. You can use your mobile phone or wearable device to register the device as a car key through the adding process. The specific key form and function supported are subject to the actual configuration of BYD vehicle models and the support capability of mobile phones or wearable devices.
1) If your vehicle has the UWB function and your mobile phone supports the UWB function and adapts to BYD’s UWB function, you can add NFC&UWB keys.
2) If your vehicle only supports the NFC function, and your mobile phone or wearable device supports the NFC function and adapts to BYD's NFC function, you can add the NFC (digital) key. The name of this app is named as "NFC key" on Android and HarmonyOS phones, and as "NFC digital key" on iOS devices.
1.2 This app offers digital key management services (including adding, removal, replacement, update, sharing of keys, vehicle door unlocking/locking or engine startup). The specific functions depend on the type of digital key you have added. For any changes, please check our official notices in time.
1.3 The adding method of digital keys is subject to the actual configuration of BYD car models and the support capability of mobile phones or wearable devices.
1) If your vehicle has the UWB function and your mobile phone supports the UWB function and adapts to BYD’s UWB function: Go to “My Car-Vehicle Settings-Doors & Windows and Locks” and tap “NFC&UWB Digital Key” to enter the NFC&UWB Digital Key interface, tap the “?” icon in the upper right corner to check the operation method, and supported mobile phone brands and models.
2) If your vehicle only supports the NFC function, and your mobile phone or wearable device supports the NFC function and adapts to BYD's NFC function: Go to “My Car-Vehicle Settings-Doors & Windows and Locks” and tap “NFC Digital Key” to enter the NFC Digital Key interface, tap the “?” icon in the upper right corner to check the operation method, and supported mobile phone and wearable device’s brands and models.
2. Subject qualifications
Before using this app, you should meet the following conditions: (1) you should be at least 18 years of age and have full legal capacity for civil conduct; (2) you should be the owner of the vehicle equipped with the BYD DiLink system and digital key function or the user authorized by the owner of the vehicle (“authorized user”). If you do not have the above qualifications, you and your guardian (if involved) shall bear all consequences arising therefrom, and BYD shall have the right to delete your digital key and claim compensation from you and your guardian (if involved).
3. Relevant fees
3.1 To add and delete digital keys, the vehicle is required to support the BYD cloud service function. Please read the User Agreement of BYD DiLink System for more information about the fees of the BYD cloud service.
3.2 BYD reserves the right to charge you or adjust the rates during the follow-up service period due to market changes, increase in operating costs, application upgrade and other objective reasons. Please pay attention to the charge announcement or rate adjustment announcement issued by BYD at that time.
3.3 The network resources required for the digital key function shall be purchased or enabled separately in accordance with your own needs; For any fault or problem in connection with the third-party resources or services you purchase or enable, you should contact the appropriate third party to negotiate and solve the problem.
4. Service changes, interruptions or terminations
4.1 In case of application changes, interruptions or service terminations of the BYD DiLink system, which may lead to digital key service changes, interruptions or terminations, you should pay attention to the recovery, correction and update progress of the digital key service along with the recovery, correction and update progress of the BYD DiLink system.
4.2 If you cancel, disable DiLink digital keys, or disable Bluetooth, location, NFC, UWB functions, or the service changes, interruptions or terminations of the digital key are caused by the spontaneous behavior of you or the actual user of BYD DiLink system, you shall bear the corresponding consequences. If you need to re-activate this service, please follow the prompts given on the application interface.
5. Rules of use and related exemptions
5.1 When you activate and use this app, you should use the digital key service in accordance with the requirements and instructions given in Help (check the requirements and instructions by tapping the “?” icon in the upper right conner). BYD will upgrade and maintain this app from time to time. Please pay attention to it in time, and use this app according to the instructions in the updated "Help". If you or the actual user of your BYD DiLink system account adds or deletes digital keys in BYD DiLink system, your digital key function will change accordingly. After a digital key is added successfully, you can lock/unlock or start the vehicle according to the permissions of the digital key. Once the digital key is removed, it will disappear and you will not be able to lock/unlock or start the vehicle. You shall be liable for any losses caused by you or the actual user of your BYD DiLink system failing to use this app according to the "Help".
5.2 Digital key is a driving aid. It is recommended that you carry your physical key along with you.
5.3 If your vehicle with the digital key is running, this app and related functions cannot be used. When your vehicle with the digital key is not in use, please be sure to lock the doors. If the doors are not locked due to reasons not attributive to this app and/or any personal injury and property damage are caused, BYD and relevant parties equipped with this app will not be liable. If you or the actual user of your vehicle equipped with this app opens the door by other means, resulting in the door unlocked, the personal injury and property damage so caused will be borne by you.
5.4 After his app is activated, if you need to sell, lend your vehicle or have other similar vehicle disposal behaviors, please be sure to remove this app or re-activate the function in time, otherwise the responsibilities and consequences (including but not limited to property losses caused to the third party who actually purchases or uses the vehicle, etc.) will be borne by you, and have nothing to do with BYD.
5.5 If your digital key is unable to be used normally or has other faults due to non-BYD reasons (including but not limited to such objective conditions as hardware and/or software faults of your vehicle), BYD will be exempt from the responsibilities, but if necessary, BYD will assist you in troubleshooting the problems.
5.6 You understand and agree that due to the limitations of existing technology, BYD may not be able to guarantee that this app and related technologies are free from any attacks, bugs or defects, however, BYD will try the best to ensure that this app and related technologies and information are safe, effective, accurate and reliable, and assume corresponding responsibilities and obligations to the extent allowed by laws and regulations.
5.7 Force majeure or other reasons beyond our control, for example (including, without limitation) war, terrorism, natural disasters, government actions, network failures, system/application malfunction, upgrade and maintenance, weather, traffic accidents, etc., may cause us to be unable to provide the service of this app to you at a specific time or place, or may affect the service quality of this app, BYD will not assume any responsibility for the resulting failure of your vehicle mobile terminal devices or the damage of equipment modules in connection with this app.
5.8 In addition to the provisions of 5.1 to 5.7 above, the "Rules of use and related exemptions" and related terms and conditions in the “User Agreement of BYD DiLink System” signed between you and BYD are also applicable to this Agreement, which you should also be aware of and abide by.
6. Information collection & privacy protection
BYD attaches great importance to the protection of your personal information and privacy. For details of the data involved in this function, please refer to the Privacy Policy of BYD DiLink System.
7. Others
7.1 All clause headings in this Agreement are for convenience of reference only and shall be ignored in the interpretation of this Agreement.
7.2 This Agreement comes into effect when you check the box in the front of the statement “Accept the Digital Key User Service Agreement of BYD DiLink System” and tap “Activate now”. If you do not agree to, or do not understand, anything in this Agreement, please do not check the box and tap the foregoing button. You acknowledge that you have carefully read and fully understood each clause of this Agreement before accepting it. You are fully aware of and agree to all exclusions of liability and your rights and obligations under this Agreement.
7.3 If any provision of this Agreement is for any reason invalid or unenforceable in whole or in part, the remaining provisions of this Agreement shall remain in force and shall be binding upon the parties hereto.
7.4 You undertake to inform your passengers, drivers or anyone using your vehicle or account of this app of the content of this Agreement and the information released on related websites, and allow them to enjoy and ask them to perform the same rights and obligations as you.
7.5 This app and services are provided, owned and operated by BYD. For any questions about the contents of this Agreement, you may contact us through our customer service hotline (400-830-3666). We will further explain and clarify the relevant contents for you accordingly.
7.6 Anything not covered herein will be directly subject to the User Agreement and Privacy Policy of BYD DiLink System, which you have accepted and will abide by.
